‘An investment in knowledge pays the best interest’ – Benjamin Franklin
In the period from 8-10 November 2022, the founder of our law firm Vranesevic Law, Lucija Vranesevic Grbic attended a three-day webinar organized by the World Intellectual Property Organization (WIPO) – Center for Arbitration and Mediation entitled ‘Online WIPO Arbitration Workshop’. The webinar gathered as speakers a number of legal experts who spoke on the subject of alternative dispute resolution in the field of intellectual property and technology law. The three-day workshop covered a plethora of significant issues in the area of international mediation and arbitration with special emphasis on WIPO’s current practice, the use of expedited arbitration rules, the review of experts on dispute resolution cases in practice and key points of the effective drafting of contractual clauses on dispute resolution, along with most common mistakes lawyers do and how to avoid them.
The expanding area of alternative dispute resolution is associated with a high settlement rate under organizations such as WIPO, approximately amounting to a 70 percent settlement rate. The first day of the workshop encompassed significant introductory statements and interesting lectures explaining 2021 WIPO ADR Rules (along with its IP and tech specific elements), mediation for resolution of IP & Tech disputes and recent developments, and practical tips for the role of the attorney for the disputing party, along with risk analysis considering BATNA & WATNA, reaching an agreement and settlement drafting.
The second day was about arbitration solely, explaining the 2021 WIPO Arbitration and Expedited Arbitration Rules, recent updates and trends, aspects of the arbitration agreement, the IP & Tech arbitration procedure plus case examples and many useful practical tips. Last but not least, the third day provided a unique industry insight provided by the Siemens Group, interesting case examples, sample dispute resolution clauses, and a how-to on drafting efficient mediation, arbitration and DRB clauses and submission agreements for IP & Tech disputes.
Finally, we would like to add that it was an honor to attend such a workshop and be able to learn from each of the presented lecturers. The workshop itself discussed a number of challenges that legal professionals face in practice, and our goal is to keep attending similar events in order to spread our knowledge and expertise. Our law firm has taken on as a core value to constantly work on expanding our professional development in various fields to keep up with fast-growing technological developments and changes in the legal practice.
